Liability Waiver
Colready Highlands HIGHLAND CATTLE EXPERIENCE and Afternoon Tea Activity Waiver & Release
This waiver forms an AGREEMENT between you (named on the booking form) and the rest of your party, and Colready Highlands of Colready Farm, Farthinghoe, Nr Brackley, Northamptonshire, NN13 5NR (the "Activity Provider").
IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:
Consideration
1. Being of lawful age and in consideration of being permitted to participate in the activity described below, the Participant releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation the activity described below, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Activity Provider.
2. The Participant understands that the Participant would not be permitted to participate in the activity described below unless the Participant signed this Agreement.
Details of Activity
3. The Participant will participate in the following activity: Highland Cattle Experience. This activity includes access to a working farm that presents hazards, such as (but not limited to) uneven surfaces, equipment, and animals.
Concurrent Release
4. The Participant acknowledges that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives and assigns.
Fitness to Participate
5. The Participant acknowledges that the Participant does not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent the Participant from participating in the above mentioned activity. If required, the Participant will obtain a medical examination and clearance.
Full and Final Settlement
6. The Participant hereby acknowledges and agrees that the Participant has carefully read this Agreement, that the Participant fully understands the same, and that the Participant is freely and voluntarily executing the same.
7. The Participant understands that by signing this Agreement, the Participant agrees to be forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the above noted activity.
8. The Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Agreement.
9. This Agreement contains the entire agreement between the parties to this Agreement and the terms of this Agreement are contractual and not a mere recital.
Afternoon Tea
All food is prepared by “The old fire station cafe” , “The Old Bakery” and “Snap and Crumble”
We cannot guarantee a nut free environment and there may be traces of nuts within all of the products
Please note that whilst we will do our best to meet your dietary requirements, due to the nature of Afternoon Tea, there may be some circumstances where we are unable to provide an alternative. Please therefore make sure to advise us at time of booking prior to your booking of any specific amendments to our usual menu. We can cater for vegans and vegetarians
The kitchen handles Wheat, Nut, Egg and Dairy products and all allergy groups in large quantities and we are therfore not able to rule out cross contamination to guests who suffer allergic reactions to any of these products. They do not have a separate kitchen designated for specific allergies.
We advise all food to be eaten in the grounds of Colready Highlands However if Visitors wish to take this of the grounds Neither the Owner of Colready Highlands or supplier of food “The old fire station cafe” , “The Old Bakery” and “Snap and Crumble” accept liability or responsibility for the condition and safety of any food remaining , after its removal from the above mentioned premises. Full responsibility for ensuring food is kept protected from contamination and at safe temperatures rests with the customer / Lead booker for group
If you are booking on behalf of other guests please ensure that they are aware of our allergen policy
Governing Law
10. This Agreement will be governed by and construed in accordance with the laws of the Country of England.
Refund / Cancellation Policy
Highland Cow Experience only requires 72 hours to either Refund or Credit note after this we won’t be able to offer any of the above
Highland Cow Experience and Afternoon Tea Combo
You have 72 hours to amend your booking after this a £30 non refundable deposit will be held for each Adult booking and £20 each child booking and any owing balance can be credit or refund back to original payment.
From 7 days before your booking takes place you will not be eligible for any refund or exchange but you may resell or gift to another person your booking.
